POLICE BEATING AND FALSE ARREST ON JAN 24, 2009
My name is Carter Harnetiaux and I was beaten and falsely charged and arrested.
I want my day in court to clear my name and to bring the Dallas Police Dept. to justice for their overzealous reactions towards a man who had no records (not even a traffic ticket at that point).
The following is a factual representation of the events that occurred on that fateful evening.
I had just finished driving an ex-postal customer (Mrs. Hamilton) to the store and to lunch when I arrived at the Austin Shelter on Hickory Street in Dallas, TX when it all began.
I drove up to the front door and asked a man standing there if he knew a Charles Jones and he said yes and to knock on the door and ask for him.
I knocked and got him and the proceeded to park across the street as I have been instructed to in the past.
Charles Jones is the brother to my longtime girlfriend at the time.
He came out to my car and I showed him some of the T-shirts that I retail and wholesale.
Charles Jones had contacting me to know if I could GIVE him and his girlfriend a couple of shirts.
After he chose the shirts, he ran back inside as it was near 32 degrees outside.
I packed up and prepared to drive off when the gentleman from the front asked to borrow my phone.
His daughter was late in picking him up and I let him call her on my cellular phone.
I have since found out his name and have saved it in several places.
I saved his daughter’s name and phone number as well.
I spoke with her an told her briefly what occurred.
I pulled out on to Hickory Street and made a left turn in front of the shelter.
I then had my eye witness hand me my coffee cup which I had left near the door.
I began to pull away and was immediately signaled by the police to stop my vehicle.
I pulled to the side of the road right away and the first thing I did was place my keys on top of my dashboard.
Two police officers came on both sides of my window and began loudly telling me to put out my cigarette.
I was doing so, but the police did not think I was moving fast enough and began shouting for me to do so.
After I put out my cigarette, I was told to give them my driver’s license and proof of insurance.
Once again I was not moving fast enough for them and the officer on the driver’s side pulled me out of the car by the shoulder of my jacket.
He then grabbed me from behind by holding my jacket by both shoulders.
He was quite aggressive and I was fearing for my safety and it turns out I was rightful to have done so.
I was prepared to be slammed against my vehicle when all of sudden I was thrown to the ground like a rag doll.
I was turning my body over to be facing up and as I did I was violently struck in the nose by the officer with a closed fist.
I was then forcefully turned over on my stomach and the officer proceeded to put his knee into my back and the back off my head.
The officer was shouting for me to stop resisting arrest and I was shouting back that I’M NOT RESISTING ARREST.
I was placed on the curb and the officers peppered me with questions.
I told them that I was a small business owner who holds dba’s in two counties and hold a state issued tax and sales permit.
They asked me where it was and I stated it was in the car along with my insurance,
They forcefully asked me the same questions over and over again and all I could do was respond that it was in the car.
There is much more that happened to me, but the bottom line is I was falsely arrested and beaten by out of control police officers.
